IMPORTANT: This Agreement affects your legal rights. It contains an assumption of risk, release, limitation of liability, indemnity, binding individual arbitration and class-action waiver. Nothing waives rights or liability that cannot legally be waived.
1. Agreement and eligibility
These Terms form a binding agreement between you and the entity operating Harbor & Flame (“Harbor & Flame,” “we,” “us,” or “our”). By creating an account, starting a trial, accessing the service or selecting “I Agree,” you affirm that you have read, understood and accepted these Terms, the Privacy Notice, Community Rules and recurring-payment terms. You must be at least 21 years old, reside in the United States, have legal capacity to contract and pass the age-assurance process required at account activation. A self-attestation or payment card alone does not establish eligibility. Failed or inconclusive checks are denied.
2. Platform only; no endorsement
Harbor & Flame provides technology for adults, couples, businesses and event hosts to discover profiles, communicate and publish content or events. We are not a dating, matchmaking, escort, transportation, security, medical or event-management provider. We do not control member conduct or guarantee compatibility, attendance, intent, health, safety, legality, truthfulness, who a member claims to be, or the quality of any venue, business, event or content. Approval labels reflect platform status only and are not endorsements, background checks or guarantees.
3. Consent, safety and prohibited conduct
You are solely responsible for your choices and interactions. Consent must be voluntary, informed, specific, sober, ongoing and may be withdrawn at any time. You must not involve anyone under 21; post another person’s intimate or private media without clear permission; record, copy, screenshot, distribute or threaten to distribute protected member content; stalk, harass, coerce, impersonate, defraud or expose private information; promote or facilitate prostitution, trafficking, exploitation or any unlawful commercial sexual service; sell controlled substances or weapons; or use the service for unlawful activity. We may report suspected exploitation, credible threats or other unlawful conduct and preserve relevant records as permitted or required by law.
4. Assumption of risk and release
Meeting or communicating with people encountered online involves inherent risks, including deception, unwanted contact, emotional distress, reputational harm, exposure of private information, theft, assault, illness, injury, property damage and other losses. You voluntarily assume all risks arising from your interactions, travel, events, businesses, venues and user-generated content. To the maximum extent permitted by law, you release Harbor & Flame and its owners, affiliates, officers, employees, contractors and agents from claims arising from the independent acts or omissions of members, organizers, businesses, venues or other third parties. This release does not apply to gross negligence, willful misconduct or any liability that applicable law does not permit us to exclude.
5. Your content and media
You retain ownership of your content. You grant Harbor & Flame a nonexclusive, worldwide, royalty-free license to host, store, reproduce, process, display and transmit that content only as reasonably necessary to operate, secure, moderate and improve the service. For the initial release, nudity and sexually explicit media are prohibited. You represent that you own or control all required rights, every recognizable person shown is at least 21 and affirmatively consented to the specific upload, and the content complies with law and these Terms. Content may be screened, restricted, removed and preserved when reasonably necessary for safety, legal compliance or evidence.
6. Businesses, hosts and parties
Businesses and event hosts are independent third parties and are solely responsible for permits, licenses, insurance, taxes, accessibility, alcohol service, security, staffing, guest screening, capacity limits, venue rules, refunds, advertising claims and compliance with all applicable laws. Listing or approval does not create an agency, employment, partnership, joint venture or endorsement relationship with Harbor & Flame. Members must independently evaluate every event, venue and host.
7. Trial, recurring billing and cancellation
A payment method is required to begin the 7-day trial. During the trial, message viewing and responses remain locked. Unless you cancel before the renewal date shown at checkout, the subscription automatically begins at $10 per month plus applicable taxes and continues monthly until canceled. You expressly authorize these recurring charges. You may cancel from Membership using a method at least as easy as enrollment; cancellation stops future renewals and does not retroactively refund charges except where required by law. Pricing or material subscription changes will be disclosed before taking effect.
8. Privacy and security
Our Privacy Notice explains data practices. Security controls, watermarks, blocked downloads and expiring access reduce risk but cannot prevent every recording, screenshot, disclosure, breach or misuse. You must protect account access, promptly report suspected compromise and avoid sharing precise location or sensitive information until you choose to do so.
9. Disclaimers
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” HARBOR & FLAME DISCLAIMS ALL EXPRESS, IMPLIED AND STATUTORY WARRANTIES, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY AND SAFETY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR SECURE, OR THAT MEMBERS, CONTENT, EVENTS OR BUSINESSES WILL MEET YOUR EXPECTATIONS.
10. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, HARBOR & FLAME WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, PUNITIVE OR CONSEQUENTIAL DAMAGES, LOST PROFITS, LOST DATA, PERSONAL INJURY, PROPERTY DAMAGE OR LOSSES ARISING FROM THIRD-PARTY CONDUCT. OUR TOTAL AGGREGATE LIABILITY ARISING FROM THE SERVICE WILL NOT EXCEED THE GREATER OF $100 OR THE AMOUNT YOU PAID TO HARBOR & FLAME DURING THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. THESE LIMITS DO NOT APPLY WHERE PROHIBITED BY LAW.
11. Indemnity
To the maximum extent permitted by law, you will defend, indemnify and hold harmless Harbor & Flame and its affiliates, owners, officers, employees, contractors and agents from third-party claims, damages, losses and reasonable legal fees arising from your content, conduct, event, business, violation of these Terms or violation of another person’s rights. We may control the defense of any covered claim, and you will reasonably cooperate.
12. Disputes; individual arbitration
Before filing a claim, each party will give written notice and allow 30 days for informal resolution. Except for eligible small-claims matters or requests for temporary injunctive relief involving misuse, safety or intellectual property, disputes will be resolved by binding individual arbitration under the Federal Arbitration Act and the consumer rules of a nationally recognized arbitration provider identified in the final attorney-approved version. YOU AND HARBOR & FLAME WAIVE JURY TRIALS AND CLASS, COLLECTIVE, CONSOLIDATED AND REPRESENTATIVE ACTIONS. You may opt out of arbitration by sending written notice within 30 days after first acceptance. If this section is unenforceable as to a particular claim, that claim may proceed in a court of competent jurisdiction in Osceola County, Florida, subject to applicable law.
13. Suspension, termination and changes
We may investigate, restrict, suspend or terminate access to protect members, comply with law, enforce these Terms or address risk. You may stop using the service and cancel your subscription at any time. Provisions that by nature should survive will survive termination. Material changes will be presented with reasonable notice and renewed assent when legally required.
14. General terms
Florida law governs except where federal law or your state’s nonwaivable protections apply. If any provision is unenforceable, it will be narrowed to the minimum extent necessary and the remaining provisions will continue. Failure to enforce a provision is not a waiver. You may not transfer your account or this Agreement without consent. Electronic records and affirmative clicks may constitute your electronic signature and acceptance.
15. Contact and prelaunch status
This public version is a non-transactional prototype and does not create accounts, perform age checks, accept payments or upload media. Before accepting real members, the final Legal Center must identify the approved operating entity, registered mailing address, support email, safety-report channel, privacy-request channel, billing contact and arbitration provider.
16. Community Rules
Strictly 21+. No minors, nudity or sexually explicit media; no nonconsensual intimate imagery; no commercial sexual services, trafficking, exploitation, controlled-substance sales, weapons sales, coercion, harassment, threats, impersonation, doxxing or unlawful activity. Do not record, copy or redistribute another member’s private content. Businesses and hosts must enforce 21+ admission, applicable permits, guest-list controls and venue safety. Violations may result in content removal, account restriction, termination, preservation and reporting to appropriate authorities.
17. Privacy Notice summary
The production Privacy Notice will describe collection and use of account, profile, approximate location, device, payment-token, moderation, communications and age-assurance result data; service providers and legally required disclosures; retention; security; U.S. state privacy rights; deletion and appeal processes; and contact methods. Harbor & Flame should receive only the minimum verification result needed from its age-assurance provider whenever feasible and should not receive full payment-card data. Precise location must not be displayed publicly. This summary is not a substitute for the final attorney-reviewed Privacy Notice.
